Missouri State Penalties
INFRACTION
Infraction: carries no authorized imprisonment and a fine not to exceed $200.00 plus court costs.
MISDEMEANOR
· Class A Misdemeanor: carries up to a maximum term of 1 year in the county jail and/or a fine not to exceed $1000.00 plus court costs.
· Class B Misdemeanor: carries up to a maximum term of six months in the county jail and/or a fine not to exceed $500.00 plus court costs.
· Class C Misdemeanor: carries up to a maximum term of 15 days in the county jail and / or a fine not to exceed $300.00 plus court costs.
FELONY
- Class A Felony: carries up to a maximum term not less than 10 years and not to exceed 30 years imprisonment or life imprisonment or the death penalty.
- Class B Felony: carries up to a maximum term of not less than 5 years and not to exceed 15 years imprisonment.
- Class C Felony:carries up to a maximum term not to exceed 7 years imprisonment and/or pay a fine which does not exceed $5,000.00 and court costs. The court in its discretion may imprison an individual for a special term in the county jail or other penal institution not to exceed 1 year in lieu of committing the individual to the department of corrections. If property was gained through committing the felony the court may have the individual pay an amount not to exceed double the amount of the value of the property obtained in the commission of the crime with a limit of no more than $20,000.00.
- Class D Felony: carries up to a maximum term not to exceed 4 years imprisonment and/or pay a fine which does not exceed $5,000.00 and court costs. The court in its discretion may imprison an individual for a special term in the county jail or other penal institution not to exceed 1 year in lieu of committing the individual to the department of corrections. If property was gained through committing the felony the court may have the individual pay an amount not to exceed double the amount of the value of the property obtained in the commission of the crime with a limit of no more than $20,000.00.

Details
Possession of 35 grams or less of marijuana is a misdemeanor, punishable by up to one year in jail and a fine up to $1,000.
Possession of greater than 35 grams is a felony and is punishable by up to seven years in prison and a fine of up to $5,000.
Possession of greater than 30 kilograms is considered trafficking and the penalty is 5 - 15 years in prison.
Possession of 100 kilograms or more carries a penalty of 10 years - life in prison.
Sale or manufacture of 5 grams or less of marijuana is a felony, punishable by up to seven years in prison and a fine of up to $5,000.
Sale of greater than 5 grams carries a penalty of 5 - 15 years in prison. Sale of greater than 30 kilograms is punishable by 10 years - life in prison and sale of 100 kilograms or more is punishable by 10 years - life in prison with no probation or parole.
Any sale to a minor increases the penalties by 5 - 15 years in prison. Any sale within 2,000 feet of a school or within 1,000 feet of a public housing project increases the penalties to 10 years - life in prison.
The possession of paraphernalia is a misdemeanor, punishable by up to one year in jail and a fine of up to $1,000.
The sale of paraphernalia is punishable by up to 5 years in prison and a fine of up to $5,000.
Please note:
• The guide does not list penalties for every marijuana offense nor every enhanced sentence such as possessing marijuana near a school, involving a minor, and automatic driver's or professional license suspension.
• Unless otherwise specified, please assume that listed penalties apply only to first convictions. Prior convictions often place a defendant in a higher penalty range, and convictions while on probation for a previous offense may result in revocation of probation.
• Except where indicated otherwise, a listed fine is the maximum fine for the conviction and the minimum fine is zero.
• "Possession" usually means "possessing marijuana only for personal use". If the government accuses you of possessing marijuana for other reasons, the accompanying penalties will probably exceed those for possessing marijuana for personal use. Possessing large amounts of marijuana frequently results in more serious charges of "possession with intent to distribute”, "trafficking", and/or "sale".
• Many factors contribute to a defendant's sentence. Factors include level of involvement in the prohibited conduct, location, age, presence or absence of minors, use or presence of weapons, conduct for which a person has been acquitted, and many other things.
