How do I apply for Social Security Disability (SSDI) or (SSI) benefits?
First, contact this office to maximize you chance of properly applying. We can help you.
After contacting this office there are four basic methods of application:
1). Telephone the Social Security Administration at 1-800-772-1213. When you call, you will be given the option of going to the Social Security office to apply for benefit. If you choose to go the Social Security office, the person at the 800 number will schedule an appointment for you and give you directions to the Social Security office.
2). Telephone the Social Security Administration at 1-800-772-1213. When you call, you will be given the option of having your application taken over the telephone. If you want to apply by phone, you will be given a date and an approximate time to expect a phone call from someone at the Social Security office who will take your application over the phone.
3). You may also apply online at www.ssa.gov If you apply online, you can do that at your leisure. Only SSDI applicants can apply online. SSI applicants must use steps 1 and 2 outlined above.
4). We can assist in the application process.
Advice about applying for disability benefits?
Yes. Please meet with your attorney before you apply. We can give you the information needed to maximize you claims success. You need to prepare to talk with us before applying. Get some notes together on the following information:
- What are ALL your medical conditions?
- What are ALL your mental, emotional and psychological conditions?
- What are ALL the prescriptions are you currently taking for your mental, emotional and psychological conditions?
- What are ALL the over the counter medications you are currently taking for your mental, emotional and psychological conditions?
- Where have you worked for the last 15 years?
- What type on work have you preformed for the last 15 years?
- How far did you go in school?
- Did you receive any special skills or training?
Make sure to give the SOCIAL SECURITY ADMINISTRATION all the information it asks for in a straightforward way. Be truthful. Do not exaggerate or minimize your disability.
Should I contact a lawyer to help me apply for Social Security Disability or SSI benefits?
There is no rule stating a person needs a lawyer’s help to file the application. We believe it is to your advantage to meet with us prior to application. After the application is filed, however, your lawyer’s help will make the difference between winning and losing.
I have already filed - Am I out of luck?
No. A very large number of our clients have filed and then seek legal help. We review you application and usually have to modify some issues. This does not hinder you claim in any way- it makes it better.
I have already lost and don’t know what to do. Is it too late to get an attorney?
No. But the letter telling you that you lost can only be appealed within 65 days of the date it was date stamped by the Social Security Administration. Many people come at the last second - we do not encourage that. Stop right now, if you have been denied and read the date on the first page of the letter turning you down. If you are near the 65 day limit call our office at 636-397-4744. Do not leave a message with the Social Security Administration. Talk to an attorney and tell them the date you were denied. This requires immediate action.
What if the 65 days has expired- am I out of luck?
No. Stop right now! Call our office at 636-397-4744. Do not leave a message with the Social Security Administration. Talk to an attorney and tell them the date you were denied and that you are past your 65 day limit. This requires immediate action on your part. Under certain circumstance we can appeal to the Social Security Administration and explain your tardiness and usually get your case reinstated. If this is unsuccessful, we will help you reapply. Reapplication is not the same as appeal and may cost you some benefits.
When do I find out if I won or lost?
With an initial application, generally within 120 days you will receive the determination. If favorable you will receive checks within approximately 60 -90 days. If you lose you only have 60 days to request a hearing.
What happens if I am denied benefits and I do not appeal within 60 days?
You'll have to start over with a new application - and it may mean that you'll lose some back benefits. So it's important to appeal all denials within 60 days. It's better if you appeal right away so that you preserve you rights. This is the stage you need an attorney in your corner. The quicker you can get to the hearing the better.
