ATTORNEY FEES
I understand that I should not spend all of my back benefits until we figure out if attorney's fees were withheld. Does it happen very often that attorney's fees are not withheld?
No. It does happen once in a while, though.
How much is the attorney's fee?
Our contract calls for the attorney's fee to be the lesser of 25% of all past-due benefits paid on your account, including SSI benefits and including any benefits paid to your family or $5300.00.
What's the difference between attorney's fees and "expenses"?
In addition to the fee of 25% of past-due benefits (not exceeding $5,300.00), our contract calls for you to pay me back for medical records or reports, etc., that I paid for in your case. SSA will not pay for these things, nor will it send an attorney any money for such expenses out of a claimant's funds.
