What is the biggest mistake people make when trying to get disability benefits?
 
Failing to request an appeal or hearing in a timely manner the biggest mistake. More than half of the people whose applications are denied fail to appeal or request a hearing. They assume that because they were turned down they are out of luck.
 
What is the second biggest mistake?
 
Going it alone without an attorney fighting for you.
 
What is the third biggest mistake?
 
NO TREATMENT EQUALS NO DISABILITY. That bears repeating: NO TREATMENT EQUALS NO DISABILITY.  This is huge! The only reason it is third is that the first two mistakes involve procedural issues that make you lose your case for failing to file paperwork. People who fail to obtain appropriate medical care or some people with long-term chronic medical problems feel that they have not been helped much by doctors and therefore do not treat. This is a huge mistake for both medical and legal reasons. First, no one needs good medical care more than those with chronic medical problems. Second, medical treatment records provide the most important evidence of disability in a Social Security case.
 

Other individuals fail to treat because they do not have health insurance. This is a mistake as judges and the courts believe if you are hurt you will find some way to treat. Additionally no matter how much the judge wants to believe you if there is sparse medical documentation they will not award you benefits. Once again NO TREATMENT EQUALS NO DISABILITY!
